Grand jury proceedings delayed

Alan Reed

Wednesday, August 20, 2008

A grand jury hearing for Devon Morris, 19; Nicholas King, 19; Christopher Futrell, 19; Michael “Chase” Oakley, 20; Marcus Mayes, 20; an unidentified juvenile suspect, 17; Horace Street, 18; and Dhayna Cavanaugh 20, accused of the alleged Memorial Day Weekend rape of a 16-year-old Trigg County girl, has been postponed. Commonwealth Attorney G.L. Ovey said that the delay stems from a need for further review of evidence against the defendants.

“I can see where some might think there is some pressure as the case has been bound to the grand jury by the district court, but we’re waiting for the results of several lab tests from the case,” said Ovey. “I’m conducting my own investigation in the case. Since there are no suspects in custody, we do not have to rush. Nobody likes to be rushed. We need to take time to review the facts of the case and conduct an investigation on our own.”

Ovey described the tests. He said that the defendants submitted samples in the case and that state laboratories have not concluded their examinations or released results.
