The summons states that at 9:30 p.m. on Monday, Sept. 3, Phillips punched David Westerfield in the mouth while they were outside near Westerfield's vehicle in the Lights Plumbing parking lot.
The report states that Phillips is due in court at 9 a.m. on Tuesday, Sept. 27.
