BREAKING: Ovey to recuse himself from Claude Russell case

In a motion filed on Tuesday, May 21, 56th Circuit Commonwealth's Attorney says he wants to be recused from the Chantell Humphries murder case.

Claude Russell was tried last year for the June 2002 murder of Chantell Humphries, but that trial ended in a hung jury. A new trial has been set to start on Aug. 19. Ovey asks Kentucky Attorney General Jack Conway to appoint a special prosecutor to the case.

Ovey cites a Wednesday, May 8, motion to dismiss by John Stewart, an attorney based out of Adams, Tenn., who is representing Russell. Ovey says that while he denies the allegations made in that document, he "cannot be a witness and continue to prosecute this case."
