The announcement came after 56th Circuit Commonwealth’s Attorney G.L. Ovey announced he was going to recuse himself from the case. Ovey said that because he expected to be a material witness at a hearing over a motion to dismiss by Russell’s attorney John Stewart, there would be a conflict of interest if he was the prosecutor in the case.
Ovey said he was glad that the office of Kentucky Attorney General Jack Conway followed his recommendation – a recommendation he formally sent on Friday, June 7 – and that when he’ll hopefully start consulting with Coleman about the case this week, after an unrelated trial in Livingston County concludes.
Russell was originally indicted for the 2002 murder of Cadiz woman Chantell Humphries, but the charges were dropped in 2003. He was re-indicted in 2011 and stood trial in August and September 2012, but that trial ended in a hung jury.
