In the lawsuit, KyTC officials claim that they spent $7,186,896.63 to repair the Eggners Ferry Bridge after it was hit by the Delta Mariner. It also claims that the crew, among the named defendants, ignored warnings that had been issued by the U.S. Coast Guard about the bridge’s navigational lights not working.
The defendants named are: Frank Altany, Jr., of Rockport, Texas, third mate; Michael Collins of Irvine, Ky., river pilot advisor; Senior Vice President of Operations Scott Merritt of Seattle, Wash; John Newland of Austin, Texas, chief mate and conning officer; Lloyd Patten of Terrebonne, Ore., master; Bobby Pepper of Mobile, Ala., general manager of the vessel; and Shaun Quinn of Kill Devil Hills, N.C., second mate.
The lawsuit had originally been filed on Tuesday, Jan. 14, in Marshall Circuit Court and was moved to Federal District Court for the Western District of Kentucky in Paducah on Monday, March 3. The accident, which the National Transportation Safety Board (NTSB) refers to as an “allision,” happened in Marshall County.
